These Terms and Conditions ("T&Cs") govern your use of our Carbon Offset services. By purchasing or subscribing to Climera's services, you agree to these terms. Please read them carefully.
1. Service Description
1.1 What We Do:
Climera facilitates Carbon Removal and Avoidance Credits through projects in the following categories:
- - Deforestation and Land Use Projects: Reforestation, afforestation, and enhanced land management to sequester carbon.
- - Sustainable Agriculture Projects: Methane reduction, nitrous oxide minimization, and adoption of eco-friendly farming practices.
- - Renewable Energy Integration Projects: Deployment of solar, wind, and other renewable energy systems in agricultural operations.
1.2 Delivery Timeline:
The CO₂ Reduction or Avoidance commitments will be fulfilled within five (5) years of the invoice or subscription date, accounting for project implementation, monitoring, and verification.
1.3 Scope of Service:
- - You are purchasing a commitment to reduce, remove, or avoid the amount of CO₂ specified in your plan.
- - Climera ensures compliance with international standards for carbon credit verification.
2. Ordering and Agreement
2.1 Ordering Process:
- - Individuals and businesses can subscribe to Climera services online or via our authorized representatives.
- - Orders are considered final upon successful payment.
2.2 Acceptance of T&Cs:
By placing an order or subscription, you agree to the terms effective at the time of the transaction.
2.3 Customization Options:
Subscribers may choose specific projects from Climera's categories based on availability during the subscription process.
3. Carbon Reduction and Avoidance Guarantee
3.1 Commitment:
Climera guarantees the Reduction or Avoidance of the net CO₂ amount as outlined in your selected plan.
3.2 Measurement and Verification:
- - Carbon impact is measured using globally recognized methodologies (e.g., IPCC guidelines, remote sensing, soil sampling).
- - Independent third-party verification ensures accuracy and compliance with international standards.
3.3 Adjustments for Project Performance:
Should projects overperform or underperform, timelines may be adjusted, but total commitments will always be fulfilled.
4. Subscription Plans and Pricing
4.1 Plans and Pricing:
Climera offers a variety of subscription plans tailored to the needs of individuals, businesses, and organizations. Each plan aligns with specific carbon offset goals and supports diverse projects such as reforestation, sustainable agriculture, and renewable energy.
Detailed pricing and plan options are available on our website or through our authorized representatives. Prices include applicable taxes unless otherwise noted.
4.2 Modifications:
Subscriptions can be modified or upgraded at any time, subject to additional charges or timeline adjustments.
4.3 Cancellations and Refunds:
- - Subscriptions can be canceled with 30 days' notice.
- - Full refunds are available within 14 days of purchase, provided services have not yet been rendered (e.g., project initiation).
5. Payment Terms
5.1 Payment Methods:
Payments can be made via credit/debit card or cryptocurrency.
5.2 Late Payments:
Late payments may result in suspension or termination of services.
5.3 Currency:
All prices are listed in USD, and payments must be made in the same currency.
6. Liability
6.1 Limited Liability:
Climera's liability is limited to the amount paid for the specific service or subscription.
6.2 Exclusions:
Climera is not liable for indirect damages, lost profits, or other consequential losses.
6.3 Force Majeure:
Climera is not responsible for delays or non-performance caused by factors beyond its control (e.g., natural disasters, regulatory changes).
7. Public Communication
7.1 Use of Branding:
Written consent is required before using Climera's name, logo, or project details in any marketing materials.
7.2 Recognition:
Climera may include anonymized customer contributions in public reports unless explicitly opted out.
8. Termination
8.1 Termination by Climera:
Climera reserves the right to terminate agreements with three (3) months' notice, with refunds provided for undelivered services.
8.2 Immediate Termination:
Breaches of these T&Cs or non-payment may result in immediate termination.
8.3 Customer Termination:
Subscribers may cancel services at any time. Refunds for unused portions will be issued as per Section 4.3.
9. Governing Law and Dispute Resolution
9.1 Jurisdiction:
These T&Cs are governed by the laws of South Africa, with disputes resolved in the courts of Cape Town.
9.2 Dispute Resolution:
Disputes will first be addressed through mediation before pursuing legal action.
